These Terms and Conditions (“Terms”) govern the access to and use of services provided by TwikiBOT Technologies (“Company”, “we”, “us”, “our”), a Website Development, Application Development, and Digital Marketing company operating from Theni, Tamil Nadu, India. By engaging our services or accessing our platforms, the client (“Client”, “you”, “your”) agrees to be legally bound by these Terms.

Services

Website design and development
Web and mobile application development
Custom software development and maintenance
Digital marketing services including SEO, SMM, PPC, and branding
Hosting, AMC, and technical support where contracted

Scope of Engagement

Services shall be rendered strictly in accordance with a mutually agreed written proposal, quotation, or service agreement. Any request beyond the approved scope shall be treated as a change request and may require revised commercial and delivery terms.

Delivery Timelines

Project timelines are indicative and dependent upon timely receipt of content, feedback, and approvals from the Client. TwikiBOT Technologies shall not be liable for delays arising from Client dependency or third-party services.

Fees & Payments

Advance payment is mandatory prior to project commencement
Invoices must be settled within agreed timelines
Non-payment may result in suspension of services
All fees paid are non-refundable unless expressly agreed in writing

Intellectual Property

All intellectual property created during the engagement shall remain the property of TwikiBOT Technologies until full payment is received. Upon settlement, ownership of final deliverables shall be transferred to the Client, excluding proprietary tools, frameworks, and reusable components.

Client Obligations

Provide accurate and lawful materials
Ensure no infringement of third-party rights
Provide timely approvals and feedback

Digital Marketing Disclaimer

TwikiBOT Technologies does not guarantee specific marketing outcomes, including rankings, leads, traffic, or revenue. Results depend on external factors such as competition, algorithms, audience behavior, and budget allocation.

Limitation of Liability

To the maximum extent permitted by law, TwikiBOT Technologies shall not be liable for any indirect, incidental, or consequential damages. Aggregate liability shall not exceed the fees paid for the service giving rise to the claim.

Governing Law & Jurisdiction

These Terms shall be governed by the laws of India. Courts situated in Theni, Tamil Nadu shall have exclusive jurisdiction.
